Hogansburg Man Sentenced to 13 Years for First-Degree Robbery and Assault

 

A Hogansburg man was sentenced July 9 in St. Lawrence County Court as the last of four men convicted in a stabbing and shooting incident in Massena.

Richard A. Herne Jr., 37, of 51 Conners Road will spend 13 years in state prison after pleading guilty on May 11 to first-degree robbery and first-degree assault, both violent felonies, in a plea arrangement with the district attorney's office.

On Aug. 3, 2017 at 10 Cook St., Apt. B in the village of Massena, Herne and four other people forcibly stole property from Sergey Barsukov, Anthony Lewis and April Cortese, seriously injuring Lewis in the process by shooting him in the torso with a shotgun.

Barsukov was reportedly slashed with a machete, but was treated for his injury and released, police said shortly after Herne's arrest.

Other defendants who have pleaded and been sent to prison in connection with the case are Alan M. Green, 25, of 193 Center St., Apt. 2, Amanda M. Terrance, 32, of 155 Main St., and Damion A. Giarratano, 23, of 243 County Route 43, Apt. 47, all of Massena.

Terrance received a six-year sentence, Giarratano received nine years and Green was sent to prison for five years.

Herne was also sentenced to five years of post-release supervision, he waived his right to appeal, and no-contact orders of protection were issued in favor of the victims.

He was also ordered to pay $2,198 in restitution and $484.90 in court fines, fees and surcharges.

Herne was on the run from law enforcement for a little over a month after the incident and was charged Sept. 8, 2017 after turning himself in to St. Regis Mohawk Tribal Police, who turned him over to Massena police.
