Day sentenced in toddler’s death

 


An Akwesasne man who admitted to killing his 20-month-old son in 2007 was sentenced this week to 15 years in prison. He was additionally sentenced to 7 years for the attempted murder of his girlfriend, the toddler’s mother, to be served concurrently.

Carson Day, now 23, will serve at least 12 more years behind bars before being eligible for release. Day pleaded guilty in December to 2nd degree murder in exchange for dismissal of a 1st degree murder charge. Ontario Justice Johanne Lafrance-Cardinal made details of the pre-sentencing report public this week.

At around 1:30 a.m. on July 14, 2007 Day’s girlfriend fled the Recreation Road apartment on Kawehno:ke (Cornwall Island) that she shared with Day and their son, Landon. She ran to a neighbor’s house with a long slash across her throat and told police on the phone she had been cut by Day with a knife. They arrived six minutes later to find Day still inside the apartment. Once police were inside Day charged them with a knife yelling for them to shoot him. The officers Tasered him and found the infant nearby already deceased from smothering.

Day‘s girlfriend was hospitalized and required numerous stitches to her throat.

According to statements made by Day in Justice Lafrance-Cardinal‘s pre-sentencing report, Day was living the smuggling lifestyle when he became hooked on Oxycontin pills.

The report stated that on the night of the murder, Day and his girlfriend had been arguing about an affair he had and consequences that were believed to have resulted from it. He had reportedly attempted suicide before police arrived to his apartment.

Day has remained behind bars since his arrest in 2007 and will remain there until at least 2022. He will need approval for parole after that time.
